Crisis in Abia PDP: Orji dragged to court over congress
An imminent crisis is brewing in the Peoples Democratic Party (PDP) in Abia State as the legality of the state Congress Committee has become a matter of litigation in court.
The PDP, in the state has been dragged to court over the state Congress Committee allegedly chaired by a cousin of the Abia State Governor, Charles Ogbonnaya.
Also joined in the suit filed by Mr. Ukasoanya O. Okocha, Legal Adviser of PDP, Nkporo Etiti Ward, Ohafia, are the Governor of Abia State, Chief T. A. Orji, National Chairman of PDP, Ahmadu Adamu Mu’azu; National Secretary, Prof. Wale Oladipo; Abia State PDP Chairman, Senator Emma Nwaka and Charles Ogbonnaya, who is the chairman of the state Congress and Primary Committee for 2015 general elections in Abia State. In the motion ex-parte contained in suit No: A/2372014, which was filed in the High Court of Abia State, in Aba, the applicant prayed the court to grant an order restraining the PDP national leadership from recognising, parading as members and or carrying out the functions of a state congress of the PDP, Abia State, pending the hearing and determination of the substantive suit for the construction of the constitution of the PDP and questions of law arising therefrom.
Okocha urged the court to make an order restraining the respondents particularly, the state chairman, Governor Orji and especially, the Charles Ogbonnaya-led congress and primary committee from conducting any congress primaries of the party pending the hearing and determination of a motion on notice. The applicant stated that it would be in the interest of justice that the PDP national leadership be restrained, so as to protect his rights and privileges as a bonafide, loyal card carrying member of the party.
“Since the October 10, 2014, the state Chairman, Senator Nwaka, Governor Orji and the governor’s cousin, Mr. Ogbonnaya have embarked on a flagrant violation and abuse of the PDP Constitution as amended up to 2012, particularly sections 25(1), S 31(1) S 50(1) of the party’s constitution.
The applicant deposed that under the combined effects of Section 25(1)(a), (31)(2) (e), 31(2)(j), 50(1)(2), of the constitution of the PDP as amended up to 2012, it was only the National Executive Committee (NEC) of the party that could perform the function of constituting a state congress where the tenure of the state congress has elapsed and or dissolved,” he further averred.
Okocha, urged that in view of the foregoing, the court should make an order restraining the respondents particularly, the state chairman, Governor Orji and the Charles Ogbonnaya-led committee from conducting any congress, primaries of the party pending the hearing and determination of the motion on notice.
